On February 10, 2003, the accuser had the defendant brought to her home. On February 13, 2003, (3 days after alleged rape) she was riding and calling around looking for him and said if she didn't find him she would have storage for his ass. On February 14, (Valentine's Day - 4 days after alleged rape), she again wanted the defendant brought to her house, but he had another girlfriend. On February 17, 2003, the accuser went to the police station.

I Will NEVER Forgive Them

My mother passed in early March of this year. She was trying hard to hold on to see her son home. Still no reply from the USDOJ. Not justice - more like department of junk. Several phone calls have come this year from political affliates who want our vote. Well one vote they will not be getting is my mother's. And at this point, I see no reason in me voting because I'm not treated like an American citizen. Officials would not help me and my family so why should I vote to give them a job. They know my name, phone number and address when they want something from me but ignore me as though I don't exist when I simply asked them to do their job - go by the law - to uphold the oath they took. The US Constitution means nothing to them. People mean nothing to them.

Just from the information I put in the e-mails to the USDOJ, they know my brother's US Constitutional rights have been violated which means he is entitled to get a new trial. But a new trial will not only reveal his innocence but it will prove that Danville city officials and Virginia state officials have broken federal law. Nasty White men still abuse Black citizens and use their official status to cover it up. And a Black official who has the power to stop them - will not. Those badges are tarnished and their hearts are rotten. White skin or Black skin it doesn't matter - the bad word is their job title - official. They protect each other.

It is like a hard blow to my chest when I hear politicians talking about American laws and pretending like this country is better than any other country. How can America be better when officials at local state and federal levels here also mistreat citizens and misuse their power like the other countries who they denounce and go to war against?

My brother is due to get out of prison later this year. Last month a female parole person came to my home to check it out because my brother will be staying with me. She looked at the family photos on the wall and asked me how old his daughters are. She asked if there are underage children that my brother will be around. Because my brother's vindictive ex-girlfriend who is older than he is, lied on him, for the rest of his life he will be a registered sex offender. His mother left this earth without his name being cleared.

The accuser is evil and so are the officials who helped her. I want to give her name but I don't know if that is legal. Should I care if it is legal or not since the law doesn't apply to me and my family? She sat in court and talked about reading her Bible. She probably doesn't own one. But then again, her and the nasty officials probably are religious. Their holy book says that a man, whose birthday they celebrate every December, was killed by religious and government officials. Some religious people are very wicked. They don't go by the Bible, because one of the Ten Commandments is ~ thou shall not bear false witness. She lied and they accepted her lie. They took a man away from his mother and children for nine years and from his mother for the remainder of her life. Not only did the nasty thing they did by putting her son in prison take a toll on my mother's health but also the cruel intimidation by the police was bad for my mother's heart. She was strong but she endured a lot. Another Black woman died with her son in bondage. She died without seeing her son one last time - to see him - free.

On March 5, 2012, my mother was up that morning sitting at the kitchen table preparing to take her insulin. We spoke briefly. A few minutes later I walked into her bedroom to find that she had simply laid back across her bed. Her heart beat was so faint I could bearly hear it. I don't think she was breathing. I think her heart was just taking it's last beats. When the paramedics removed my mother from our home, I had to ask that they cover her up. No respect, no dignity for an elderly Black woman. At the hospital they had her hooked to things and was shocking her heart. Her body was cold when I touched her. She wasn't breathing on her own. My mother was gone so I told the doctor to let her go. I don't hate any of them because it is not in me to hate. But I will never forget and I will never forgive them.

Perhaps I should not have written this because the - officials - might not like it - and come up with a reason to not release my brother. If they do let him out, they can arrest him anytime and send him back inside. America. This particular post might not be up long. So if anyone is still reading this blog copy it and past it on to your friends or save it as a reminder that there is no justice for some citizens. I don't trust the - officials - so I will probably remove it. I just needed to post it - to update anyone still interested. All those lawyers and organizations and no one would help us. Well, I'm through asking for help. They won.

Some Wounds Never Heal

I apologize for not posting anything in a while but I've been working. I am so disgusted that such injustice still exist and just reading, just thinking about this case alters my usually pleasant mood. In the early stages of trying to deal with the police intimidation while trying to work took me close to a dark place and had me angry and depressed all the time. Years have passed but not a day goes by that this case is not on my mind. And now that I am employed again, I'm trying to keep my head clear and not go to work depressed and angry like I use to do.

Time heals some wounds but some are so deep that it can't ever heal. Time has dulled the pain but the internal wounds will never fade. There will always be a nagging ache in my heart that time will never make totally go away.

Can anyone explain to me exactly who are citizens suppose to report complaints to when the complaints are against officials?

Months have passed and the USDOJ still has not replied to my e-mails. It's the federal government but how long should a citizen have to wait to just receive a reply?

Okay I have to stop now because I have to go to work tomorrow and I want the dark moody clouds to go away so that my head can clear.

In a few weeks I will have enough off time to post the testimony from the preliminary hearing and trial transcripts and notes from the defendant's file written by the so-called defense attorney.

Sent Another E-mail to the USDOJ in DC

Today I sent another e-mail to Mr Holder and the USDOJ again requesting an open investigation and a fair trial for the defendant. Need I say how disappointed I am that it takes so much effort and time to reach officials and try to get someone to investigate this case? I have been reading different reports on the web so I know that I'm not the only one needing help but don't you think, well, I think the USDOJ could at least have acknowledged my first e-mail by saying someone will be in touch. Since so many people are employed by the USDOJ there should be people to just deal with e-mails. Or use an automated reply.

I saw a video of Maxine Waters trying to help people in her district not lose their homes. She ran into the same problems that ordinary citizens do when trying to contact businesses by phone. If we reach a real person, that particular person can't give us information that we need, but connect us to someone else. Then the line is disconnected or if we reach someone we still get little or no help.

How did America get this bad? Or has it always been like this and I was naive to think our systems worked better - that our officials worked better than this??

Why Can't Citizens Comment on Certain Articles?

August 8, 2010/Sunday. This morning a neighbor brought over an article she knew I would be interested in reading and saving. I no longer buy the Register and Bee. "Chatham man files complaint against police department". Chatham is in Virginia. The newspaper article is dated Saturday August 7, 2010. On the internet, an article about this same story, dated August 6, 2010, is no longer taking comments. Commenting has been deactivated and comments are hidden. HA!

Okay readers, are you getting more understanding about how Virginia newspapers don't allow citizens to comment on certain topics? I can only speculate about what people could have possibly commented about a Virginia police officer violating the rights of a black man in Virginia. But I don't know exactly what comments were made and if you go read the article, you will not get to read the comments either. The URL to the article is:

The Virginia State Attorney's office and the United States Department of Justice in Virginia and Washington, DC probably have so many complaints against police officers that they just ignore them all. Where does that leave Virginia citizens? It leaves us at the nasty hands of corrupt/racist officials who know they can do whatever they want to us because higher officials ignore complaints against them.

Thank You Imo

Thank you Imo. Thank you for taking the time to read this blog. Thank you for taking the time to comment.

I am not a violent person. I do not own a gun. It was back in 2004 when I contemplated getting a gun to protect me and my mother from the police who were coming to our home so frequently and sitting outside our home.

In 2003, my close aunt passed and about a month later my brother was accused of rape by his ex-girlfriend. My mother is in ill health and I'm the one with her. And then on top of that dealing with the police. The pressure got to me and I was close to coming apart. To be honest, I was close to that edge and if anything had happened to my mother, I don't know if I would not have stepped over that line. There is such a thing as pushing people too far.

I have always believed in the law and when younger thought about being a police officer. It hurts to be mistreated by not only the police but other officials who are suppose to be representatives of the law. It hurts to know that in 2010, the Constitution of the United States still do not apply to Black citizens. And it doesn't ease the pain to know that it is not only Black citizens who are denied their legal rights.

I have made sure that many people know about this case as a form of protection from the police. Of course in America, unarmed Black citizens can be killed by the police with little or nothing done about it, but I wanted people to be aware so that if the police did do anything to me, maybe people would ask questions and not just go by what the media reported.

A few days ago I read an article about a woman who became a lawyer just to help her brother and she eventually got him released from prison for a crime he did not commit. In America, no one should have to go to that extreme to get justice.

Again, thank you for showing concern. And I thank all the people who have taken time to read this blog. Please continue to visit because I have more to post. I hope to eventually get justice and I hope that anyone who is having a similar experience of not getting justice will continue to fight for it. I am trying to reach one honest official who will investigate this case and a news journalist who will do a story on it so that even more people will know about it. Maybe even a lawyer will offer assistance. Justice and equal rights have to be fought for when it is stolen from us. Hopefully Mr Holder will do something about this case.

Honest Officials Would Do Something

UPDATE: Richmond Times Dispatch did delete the comments I made there yesterday. Now if Virginia was really interested in trying to curb wrongful convictions and repair the legal system then why not let citizens speak publicly? I think I read somewhere that Texas, Florida and Virginia have the highest rate of wrongful convictions. There have been articles about Texas and Florida forming committes to look at this problem and now Virginia is saying it will "study". Study what? If they let people talk and they listened then they could review cases, give new trials to those who were denied fair trials, let defense witnesses testify, do DNA test and get rid of officials who broke the law by denying defendants their constitutional rights. That is called - DOING SOMETHING to fix the problem.

Officials need to do things because it is the right thing to do and stop playing politics with people's lives. That is why America is in the mess it is in now. Those in power grab the money, don't regulate anything, and let American citizens be abused. If citizens can't be protected from the police and court officials then how can America be protected from outside terrorist? America's legal system was suppose to be one of the things that set us apart from other countries. American citizens were suppose to have rights that would keep us from being grabbed off the street and lock up without due process. When the police and court officials don't give fair trials, and the media don't report on what is taken place inside a court room, then just how many people are denied fair trials because there are no officials to complain to who will investigate and do the right thing?

In Danville, The Sting is a free paper that list crimes and people who are wanted by the police. The paper prints pictures of people giving their names and addresses. Danville also has a tv segment where they do this. But neither The Sting nor the tv segment tell if these people were found guilty of what they were accused of. So the question is how many Danville citizens have not been given fair trials and are shipped off to prison? Neither paper tell court dates of cases so how many court rooms are empty with only the officials and a few (or no) family members present. And the family members are not given access to the newspaper. Perfect set up - for the prosecution.

I read a headline that was something about America looking at other countries to see if we could use anything from how they do things legally. There is really no need for that because if officials would just enforce the laws that are already in place then things would improve here. The problem is that there are some people above the law. When federal, state and city officials break the law, little or nothing is done about it. But when an average citizen is accused of breaking the law, they are arrested. And if their rights are violated by officials little or nothing is done about it. But if the legal rights of an official is violated something is done about it. That's not equal. When a citizen is accused of a major crime and is not given a jury trial but his fate is decided by racist officials and he doesn't have a lawyer to protect his rights then that is NOT EQUAL. When evidence is withheld by officials that would help the defendant then things are NOT EQUAL. And when officials do nothing about the corrupt officials then there is NO JUSTICE.

The President gives pretty rah rah speeches but has he or the head of the USDOJ, publicly spoken about doing something about America's legal system that currently isn't working properly? A system that currently has people, who "look like" them locked up and did not receive fair trials. White Americans should have no problem with that since some White people are also incarcerated for being wrongfully convicted. America has an abundance of people, many who are currently out of work. Jurors are not paid much but it is a citizens duty to be a juror. If people who helped to crash wall street can get million dollar bonuses then jurors should be paid a decent wage. Of course citizens don't want to be jurors when they are not paid adequately and end up on the losing end because they lose money being away from their job. Well now that so many citizens are out of work, let them make some money by being jurors. Why do officials pretend like it is so hard to do things when all it takes is to go a head and do it?

To improve the system, make the ones who work in the system accountable and not give them the power to corrupt the system by breaking the law from within. If all people were honest there would be no need for law and courts because everyone would do the right thing. Most people do the right thing and not just because laws say they have to. So why do officials, who are just people, get away with breaking the law? Why act like those who corrupt the law are the only ones who know how to operate our legal system so they can't be gotten rid of. That's sort of like wall street and the bank situation. They are too big too fail so keep them and let them continue doing what they have been doing. With all the people in America, only those who have damaged the system know how to run it? What kind of crap is that? Are American citizens so inept and stupid that there are none who can replace those who have have messed up so much of America's systems? Our economical, medical, educational, and legal systems are damaged and will only be repaired when officials start doing their jobs and if they will not they need to be fired the same as the average employee would be if we didn't do our jobs adequately. So much for - of the people and by the people - when the people have no control over the officials who work for us. Heck, we don't even have access to officials who work for us.

I am tired of waiting so I'm thinking very seriously about not only posting the testimony of the accuser and defense witnesses but also the names of the tampering detective and the others. If a racist can blog saying nasty things about all black people and not have his blog removed then I should be able to give the names of officials who broke the law and not have my blog removed. Seven years is a long time to wait for justice in a country that is suppose to be about EQUALITY and JUSTICE. If all people are created equal, then why do officials get to break the law and not be punished while innocent people go to prison and citizens are abused for reporting corrupt officials? Honest officials would do something to make things better and not ignore the problems and not ignore the complaints of citizens.

Richmond Times Dispatch Deleted My Comments

I know I keep saying I will post the testimony by the accuser but I keep hoping that the USDOJ in Washington DC will respond to say it will investigate this case. I don't want the excuse of I posted something that would keep the defendant from getting a new trial - a fair trial. As we all know, it seems to take officials a long time to do things, so I'm still hoping that Mr Holder or whatever department my e-mail was directed to will respond. There seems to be many things going on right now that the USDOJ is dealing with, but one would think that an e-mail would be sent to say it has been received and it has been sent to the appropriate department, and tell which department so that I (and others) would know which department to contact for a follow-up. To just ignore citizens is wrong. How can government be open and transparent when citizens don't have access to our officials - don't have access to the law?

I have posted comments on other sites, the most recent at Huffington Post and Richmond Times-Dispatch. At Huffington Post, my comments were not removed. At Richmond Times-Dispatch I commented on two articles that was about Virginia's legal system. I made a comment at both of these articles and both comments were removed. When I asked why my comments were removed but the comment by someone else saying black people committed more crimes were not removed, the Richmond Times-Dispatch removed that comment and removed the comment about black people committing more crimes. It is okay to say negative things about black people as a whole group but it is not okay to say negative things about corrupt officials.

Today I posted again at the same two articles at Richmond Times-Dispatch. Removing my previous comments just proves what I have said about southern white-owned media denying access to citizens who want to talk about corrupt officials. If you go read the two articles, notice that it is okay to say something negative about a senator by name but saying something negative about corrupt Virginia officials who violate citizen's legal rights are not allowed. Notice that someone commented on the man's beard and not the article and it was not removed. I will check back later today to see if my comments, which were on the subject of the articles, have been removed.

At Huffington Post, a lot of people commented on the article about Michael Green who has been exonerated after spending 27 years in prison for a rape he did not commit. Many people commented at that article showing compassion for Mr Green and telling about corruptiong and wrong doing by officials in their states. Those comments were not removed, people were allowed to speak and share what was going on in their states.

Someone from Ireland commented that America has a lot of people incarcerated compared to other countries. Some countries view America as being arrogant and violent. And some racist Americans think black Americans are more violent and commit more crimes than anyone else in America. Just because American prisons are filled mostly with black people does not mean that more black people commit crimes - more like it is easier to convict black people, which doesn't speak well of America. By different people commenting about is going on in their area with our legal system, then more people will start to see a clearer picture that incidents of wrongful convictions and corruption are not just isolated occurrances. This injustice needs to be fixed and not just studied.

The media should tell more of these stories and not just when someone is released from prison. If the media covered major cases and truthfully reported on them and allowed citizens to publicly report corrupt officials then that would improve the legal system. You can't fix what is broken by just saying it is broken but don't do anything to fix it. America's legal system need some expert repair because this mess can not be fixed with duct tape.

The Dog Incident (& the inhumane society)

In 2004, the head of the Humane Society came to my home saying she wanted to take my dog to be examined by a vet. My dog had a growth on her side. I gave her my dogs info and was going to let her take my dog to be examined but I read the form before signing it. She had checked that I was giving her permission to kill my dog. I ripped the form up in her face and told her to get off of my property. She called the police. The White police officers came and then they called a Black cop. I had called relatives and made sure my neighbors were present to see what was going on. I wanted witnesses. The White cops stood to the side and let the Black cop do the threatening. The Black cop said he was going to break down my door if I didn't turn over my dog. I refused. He threatened to arrest me and my mother. My mother is in ill health and did not want to spend Christmas in jail. She was destressed and so I let the cop take my dog after he promised he would take care of her.

I called the Humane Society to find out where my dog was and was given the name of the vet. The vet told me over the phone that my dog was too old to be operated on and that I could have her back. But the Humane Society did not bring my dog back. They locked my dog up and in January 2005 I had to go to court to keep them from killing her. Not a nice Christmas with my dog and my brother locked up. I subpoenaed the Black cop who took my dog but he did not appear in court. The judge said I could postpone or continue. My witnesses were present and the court room was full of Black people waiting their turn so I decided to continue so that all those people could witness my case. I had the feeling that the officials didn't think I would show up. I didn't want an empty court room like it was for the fake rape trial so I continued.

The people from Human Society came out of a side room with a prosecutor and the vet. The prosecutor took me and my mother into a room and asked me what I wanted to ask the cop. I wouldn't tell him. I had talked to the Black cop about the officials in this case of course so the cop didn't show up. The prosecutor wouldn't look at me but kept his eyes closed. Yelp, he was one of those who can't look people in the eye. In the court room, he went first asking the head of the Humane Society questions. She said she told me that she was going to add at the top of the form that my dog was to see the vet. Neither the judge nor prosecutor said anything but I know that the form would not be valid if she added to it after I signed it. I'm Black so I'm suppose to be stupid. If I had not read the form first, she would have killed my dog. So much for her being humane. I gave her the form that I had ripped and told her to read it. She excluded part of it so I told her to read the whole thing. I asked her where did she get the information (name, age) about my dog. She said from me, which means I was going to let her take my dog to be examined until I saw the form. The vet testified that she didn't think my dog, due to age, would survive surgery, so I should have my dog back. The prosecutor had the nerve to say that I wasn't asking questions but making statements. I'm not a lawyer but this guy wanted me to behave like one. Okay, I did and I beat him. Yelp, I won the case beating the Humane Society and the prosecutor.

The judge let it be known that this wasn't an animal cruety case. The vet said my dog was old and the judge said he had an old dog too. He ordered the Humane Society to return my dog after I paid for rabies shot. In the hallway of the court house, the head of the Humane Society was grumbling. I don't know if she padded the bill but if she did, she had lunch on me and I don't care - I beat her. Before I went to court I had gone to the shelter to see my dog. She looked at me as if asking when was she going home. It hurt leaving her there. After court, I went to the shelter to get my dog and the head of the Humane Society told my dog she was sorry she had to give her back to me. Did that woman actually think my dog would prefer to be dead than live with me just because she had a growth on her side? The head of the Humane Society not very humane.

When my dog got home, she was quiet because she didn't know what she had done to be sent away and didn't want to do anything to be sent away again. I had to play with her to assure her that she was home and could be her pesty self. She had bugs on her that she had gotten from the shelter. She died a year later, in her spot in the hallway, at home with her family. She was sixteen or seventeen years old.

I included this story to show how even Danville's Humane Society officials are not so humane. What was the real reason for wanting to kill my dog after the vet said I could have my dog back? It cost money every time the court room lights click on and people have to take time out of their lives to go to court. So what was the reason for it? And to give an extra idea of unfairness, nothing was done to the Black cop who didn't appear in court even though I summoned him, but my neighbors, a married couple, were arrested when they didn't appear in court. That case was about disagreeing over household finances and they were arrested for not appearing but the cop was not arrested. There are different rules of law for civilians and officials. Officials are above the law.

Stand up for yourself and your family which include your pets. Don't let officials get away with mistreating you in any kind of way. Up to now, there still has been nothing done officially about the defendant being denied his constitutional rights but at least I tried and still try. Maybe fifty years from now the defendant will get justice. At least my efforts have gotten some of the corrupt/racist officials involved in this case to resign. And the tampering detective is now just a spokesperson for the Danville police department and is not working cases.

Stand Up

I know, I haven't posted the testimony yet, but I will. The visitor counter keep rising and when it hits 100 I will post it, which should happen this weekend. I have been posting about this case at different sites to generate visitors. I suggest to others who have blogs they want read, you should post comments at other sites. It helps mentally to just get the story out there even if nothing will be done about it. There are different organizations that are working to help people who are wrongfully convicted but there are so many cases that there is not enough help out there. Well, if the USDOJ and state officials would do their jobs to help people then more people would be out of prison and back with their families. I read one story about a man who was exonerated but his mother had died before he got out. My mother prays that see lives to see her son free. She wants to cook him a big dinner. I send words of encouragement to all who have lost a love one to death or is wrongfully incarcerated due to misconduct by officials.

Yesterday I read that the White police officer who shot Oscar Grant, an unarmed Black man, in the back was found guilty of involuntary manslaughter and will get maybe 2 to 4 years. Most White people in America don't seem to know about the many abuses upon Black people by White officials because the White-owned media doesn't tell them. And when an incident does get coverage in the mainsteam media, it just makes it seem like an isolated incident that is blown out of proportion. Well one unnecessary death of a Black person is one too many. One person wrongfully incarcerated is one too many.

Why do people keep bringing up O.J. Simpson when there is a discussion about the injustice for Black people? If that is the only case that someone can use as the legal system working for a Black man, then that says volumns.

The police broke into a home and killed a Black child. The police broke into a home and killed a Black woman and shot her baby. A Black man was shot by a police officer who pushed his mother, after he was pulled over because the cop had the wrong person. Luckily this man survived. These are just three incidents and Mr Grant's death makes four but there are so many others. Where are the cases of police shooting unarmed White people?

By the comments posted about Mr Grants death, it shows that there are people who think that Black people should just always comply with the police. Why should Black people trust that we will not be killed if we just stand still or lay down when the police tell us to. I'd rather die on my feet than lay down and let a coward shoot me in the back. I will never allow the police to put handcuffs on me. I think about what if I have to call a rescue unit to take my mother to the hospital, will I have to deal with cops when I tell them they are not allowed in my house?

In Danville, Virginia in the new millinium, the police slaughtered an unarmed Black man in his home. The police say they thought he had a gun. The Danville police threatened to break down my door because I wouldn't let them kill my dog. I told them to go get a warrant which they didn't do because they had no reason to take my dog. In 2005, police headlights shined on my mother's bedroom window from 3:30am until daybreak but my mother was in the hospital. The police have watched and spotlighted my home. The police have been to my home on false pretenses. How many people are suppose to live at my house? It's only me and my mother but the police claim to be looking for people at my address that I have never heard of. One day the police pulled me over when I left the doctors office with my mother. I did not get a ticket because they just wanted me to be aware that they could do it anytime they wanted to. One day a female cop kept pushing her way into my house even though I was blocking the door telling her to get out. She of course had a gun on her hip and if I had put my hands on her that would be considered an assault against a police officer. The police use any opportunity to come to my house. The incident on the night of the headlights and the other with the female cop had nothing to do with us. The police was in the neighborhood because of a disturbance involving other people not us. But since the police was there, they used the opportunity to mess with us. One morning, the police came to our home while my mother was doing a breathing treatment. The police claimed to be looking for someone again who didn't live at my house. It was early, the school kids were waiting for the bus and I was in my bedroom. The cowardly police ran when my mother called me. The children laughed. There are other incidents of the police coming to my home since I reported the tampering detective.

It's not a good feeling knowing the police can kill you and nothing will be done about it. But I will not just step aside and let the police invade my home when they have no reason to. I don't have a gun but I am not scared of them. The cowards.

I am so sick of White officials being allowed to abuse and kill Black people. And then those who don't have to deal with racist officials say Black people should just allow officials to treat us like we don't have rights. If unarmed White people were being killed by the police the way Black people are, I suppose White people would just never come out of their houses because some seem to be too scared to stand up for their rights. And if they will not stand up for their own rights then they will not stand up for the rights of Black people. And not standing up for each other lets the officials get away with violating the rights of those who don't have the finances to fight them.

There is still no justice in America for Black people who are still not treated like citizens who have rights.

4th of July - Still No Justice

Today is the 4th of July but I don't celebrate it. I will spend part of today working on the post I hope to put up tomorrow - the testimony of the accuser from the preliminary hearing and the trial.

Danville, Virginia - what a legacy - to be known for being the last capital of the confederacy, the wreck of the Ole 97 and the most violent Virginia city during the Black Civil Rights Movement.

In Washington, DC there is a confirmation hearing for another federal judge. Federal officials use words like - Constitution and Rules of Law, but they are the ones who don't enforce the law. So what good is law and what does it matter if a nominee is a woman, a person of color or a man if the law is not enforced all over America? If people don't have the same legal rights then what is the point of court rooms?

I read that in Florida and New York there are commissions or some type of program underway to try to decrease the number of wrongful convictions in those states. I looked for something written about wrongful convictions in Virginia to see if my state was doing anything about it. I read an article from last year that "Then-Gov. Mark R. Warner ordered a sample testing of 31 of the old cases,...". ARTICLE.

Wait a minute, when I sent a fax to then Governor Warner, who is now a Senator, I received this reply:

Governor Warner has no authority to intervene in legal matters.

Ordering DNA test that exonerated prisoners and stopping someone from being executed and granting pardons IS intervening in legal matters. So why didn't Governor Warner do something about the detective who tampered with a defense witness? He didn't contact anybody to get an investigation started so that the defendant could get a REAL fair trial.

In 2004 I received a reply from Mr McNulty who was then the Eastern District U.S. Attorney of Virginia:

Have you read or heard about the corruption in the U.S. Dept of Justice during the Bush Administration? Dismissal of U.S. Attorneys So why is there talk of impeaching Obama due to somebody not liking how the USDOJ is operating now. Disagreements within the USDOJ leaves the citizens with no protection at all. Who responds to the complaints of ordinary citizens?

On July 14, 2004 I sent a fax to the United States Dept of Justice - Office of Professional Responsibility in Washington, DC. It is now July 4, 2010 and I have not heard from the USDOJ. Even if that department does not handle complaints about a citizen being denied his Constitutional Rights, my fax should have been sent to the department that does deal with complaints of this nature.

On May 20, 2010 I sent an e-mail to the USDOJ in Washington, DC and have not had a reply. Why no reply?

Am I being impatient? Seven years of waiting for justice is not impatience. I am an American citizen. I made a complaint against the police detective and about the defendant being denied his CONSTITUTIONAL RIGHTS. But officials (city, state, federal) has done nothing about this case and the JUSTICE DEPARTMENT does even bother to reply.

Can anyone reading this blog please tell me what Department in American has the authority to do something about a defendant being denied his Constitutional Rights to a fair trial, legal representation and a fair appeal? Witness tampering is illegal - which department handles that?

What Department in America investigates misconduct by officers of the court and police officers?

What Department in American protect citizens from corrupt officials?

Why should the Virginia State Attorney's office defend Danville officials who broke the law and don't help the citizens whose constitutional rights have been broken?

The public defender did nothing about the witness tampering, did not properly protect the defendants rights, properly represent his side of the case, etc and he gets to represent the defendant in the Court of Appeals? The public defender is paid by the state the same as the prosecutor. Even Michael Jordan on his best day wouldn't stand a chance playing by himself against a whole profession team. What's fair about that?

The Virginia State Bar of course has no evidence because it did not investigate the complaint. The prosecution had no evidence except for the accuser's complaint. So the complaint by the state witness is evidence but a complaint against the public defender is not evidence. A complaint should start an investigation UNLESS it is a complaint against officials.

The public defender "abandoned" his client when he did not put on defense witnesses at the preliminary hearing and the grand jury hearing. He also did not summon all the people who could have been defense witnesses. He did not let all the defense witnesses he did summon testify. At the trial, he did not play the preliminary hearing tape that has the accuser saying her cousin, a defense witness, was there that day to impeach her trial testimony where she claims he was not there. He did not mention the tape in the appeal petition so he probably did not submit the tape to the appeal court. AND he did NOTHING about the police detective TAMPERING with a defense witness.

Now tell me, who investigates city officials who are corrupt? Who investigates the police department? Who investigates the district attorney's office? Who investigates the public defenders office? Who investigates the judge? They will investigate themselves?

I didn't vote in the last elections for Danville officials or Virginia officials. They want my vote but when my rights are violated they ignore me. And some break the law and get protection from other officials. I will no longer vote in the national election to choose a President of the United States of America. Since I am still treated like I am not an American, then I will no longer vote to put people into office who don't uphold their oath to defend the laws of the United States Constitution of America. The U.S. Constitution wasn't meant for Black people when it was first penned and it doesn't mean anything now.

And the framed Declaration of Independence is no longer on my wall. I don't celebrate the 4th of July.

Pushed to the Back of the Bus Again

Tonight I read an article that said the United States Department of Justice will file a lawsuit against Arizona to "strike down a new Arizona law aimed at deporting illegal immigrants".

A month ago Thursday, I sent an e-mail to U.S. Attorney General Eric Holder (USDOJ) requesting an investigation and a fair trial for the defendant for whom this blog is for. The USDOJ has not bothered to even send me an e-mail saying someone will contact me and there will be an investigation. An American Black citizen has been denied his CONSTITUTIONAL RIGHTS but the USDOJ show more concern for people who are in this country illegally.

What is this? Black American citizens don't have rights but illegal immigrants do?

Mr Holder and the USDOJ, you are showing no concern for black American citizens. The defendant in this case has been illegally incarcerated for seven years. He has been denied his CONSTITUTIONAL RIGHTS. Give him a fair trial. GIVE HIM A FAIR TRIAL. I am not asking for anything special only what the defendant is entitled to -- A FAIR TRIAL.

This case is a situation that can be easily resolved in less than a week. The oil spill and unemployment, etc is on going and who knows when it will improve BUT THIS CASE is something that federal officials can do something about now.

The officials who purposely denied the defendant his rights are just men. Being white men does not make them more important or better than the black man they denied a fair trial. They are not suppose to be above the law just because they are officials. They are not suppose to be above the law because they are white.

I had intended to have posted more by now but sometimes I have to take a break from this just to clear my head. It's very disturbing that black American citizens are still not treated fairly by officials in Virginia and the federal government does not help us.

Recently, at the sidebar there was an item about the Utah Attorney General investigating a Utah police department. ARTICLE But two Virginia Attorney Generals did nothing about a police detective tampering with a defense witness. Is Virginia still part of the United States of America? In America, black people are suppose to have legal rights, but in Virginia we don't. How about it United States Department of Justice, do black people in Virginia have the right to a fair trial, legal representation and a fair appeal? I'm still waiting to hear from you. Am I being ignored by you? All I'm asking for is -- JUSTICE.

If there are no laws to protect black American citizens from being abused by officials then there are no laws that black citizens have to follow. If the police can break the law then the police are not enforcers of the law so should not be allowed to arrest anyone. If court officials break the law then they should not be allowed to hold court against others.

Black American citizens have been pushed to the back of the CONSTITUTIONAL RIGHTS bus while illegal immigrants sit in front of us.

Was An Appeal Petition Filed?

I did a search at the Court of Appeals and the Supreme Court of Appeals website but did not find published or unpublished court decisions for the defendant. Now I'm even more convinced that no appeal petition was ever filed by the public defender. Which is another violation of the defendant's legal rights. This guy doesn't deserve to be called a public defender.

I think American citizens should be more active in how our country is ran. We elect officials at the city, state and federal level. We need to make it so we can vote officials out of office when they need to go and not just at the official election time set up by the government. If officials don't care enough about the law, then they should not be getting paid when they don't do their jobs. And the ones who break the law should go to jail. And the ones who are accused of breaking the law should be put on trial before the public. Too many things in America are done behind closed doors. Officials are public servants which means they are suppose to be working for the people. But they have too much power. If they violate their oath to uphold the law or even look the other way knowing that the law has been broken by their colleagues then they need to be fired.

A woman working at a tobacco plant was fired because a supervisor said he caught her sleeping. It didn't matter if she was maybe tired because she had a sick child or some family situation that caused her to be tired. Maybe the tobacco job (seasonal work) was her second job because she needed the extra money so was just tired. It didn't matter, she was fired with probably no questions asked. Ordinary citizens can be fired from jobs with no reason given.

But elected public officials don't have to do the job properly. And if they are being investigated for something illegal they still get paid while off duty. That's not right.

America have symbols that really don't mean anything. For instance, Lady Justice, the blindfolded woman holding the scale and a sword, seen on court houses. Justice is suppose to be blind, so she wears a blindfold. That blindfold is see-thru. That sword represents vengence and justice. Do I need a sword to get justice? Do I get to take revenge against those who have done me wrong?

Out on Guantanamo Bay, people are being held captive as enemies of the United States. But they have not had trials so have not yet been found guilty of the crime of which they have been accused. Now that the sordid mess has been made public, the prisoners are suppose to be getting public trials. Lawyers will be appointed to represent them.

The defendant in this case is an American citizen who has been denied his Constitutional Rights to a fair trial, legal representation and a fair appeal. The lawyer, paid by the state, worked with the D.A.'s office against his client. So in fact, the defendant did not have a real representative to present his case and protect his rights. When will he receive a fair trial with a real lawyer before the public and with a jury? Why doesn't he get the same rights as those who are accused of being enemies of the United States of America?

Witness tampering is illegal but after seven years, the detective is still on duty getting paid. There has been no investigation. Yesterday I read a blog post about a police officer in Texas who was indicted for tampering with a police report (ARTICLE HERE). But in Danville, Virginia, a police detective tampered with a defense witness and neither Danville nor Virginia officials did anything about it.

One of the Virginia governors that claimed not to have the authority to do anything about this case is now a senator. How can the head of a whole state not have the authority to do something about a citizen being denied his Constitutional Rights? All he had to do was make a phone call to get an investigation started. He could have came to Danville in person. But he didn't care enough. And now he is a U.S. senator. Ohh, I want to name names so bad but don't want this blog shut down. You see, he didn't care about the laws of the United States and the rights of citizens, he ignored the injustice at the city and state level so how much will he care about the law now that he is a federal official? He has proven that he is a good ole boy and will play the game of protecting corrupt officials while he sit in his high office.

Some state attorneys also ignore corruption by officials because they want to be governor. And then maybe a senator and who knows they maybe even aspire to be President of the United States. I've seen a tv commercial that says a political candidate is endorsed by a police department. Police officers are individuals and should vote as individuals so how does a whole police department endorse a political candidate? And if that candidate gets elected, he will not investigate the police for wrong doing.

What about at the city level. Why would a prosecutor who has been head attorney for so many years, and seem to have no aspiration to go further, break the law, violate his oath? Does his conviction folder need to be bulging for him to have a successful career? Maybe he intended to be a city judge one day. How scary is it that a corrupt prosecutor can become a judge? Well at least some of those corrupt/racist officials on this case are no longer on the city payroll.

Some prosecutors also move into more powerful positions. They become judges or state attorneys and state attorneys become federal attorneys. Some prosecutors do their jobs right. I read another article yesterday, it was about a woman who made a false rape complaint. Her complaint was investigated and found to be false so she was arrested for filing a false complaint. Danville officials knew the accuser in this case was lying but the prosecutor took it to trial and it was all kept very hush-hush with no public notice and no jury and no press. The public defender wrote in his notes before the trial that the accuser had made inconsistant statements and had been impeached by others. And at the trial she kept changing her story but officers of the court just ignored it because it had already been decided that the defendant was going to be found guilty. (I'll be posting her testimony soon.)

Judges are people who are in positions to decide who goes free or goes to prison and for how long. And who monitors a judge to see that he does his job right and that his bias doesn't interfer in his being fair honest and just? The prosecutor and the defense attorney can report misconduct by other court officials so why has nothing been reported by them? WHY did the public defender not do something about a defense witness being tampered with? Why didn't he report that the judge and prosecutor also accepted the accuser's perjured testimony?

In a letter to the defendant he agreed that the defendant did not get a fair trial. But he didn't do anything about it. Why? Because they are all corrupt and worked together to send a man to prison without giving him a fair trial. WHY? Did they need another conviction that badly? How many others have they did this to? (I don't feel like looking for the article about the 100 cases that was thrown out because of one corrupt cop.) Are they just racist and had the opportunity to send another black man to prison? Do they have stock in the prisons? Is it a power thing of being able to take away a man's freedom for as long as they want? Maybe all of the above. If these men were brought to justice and stood before the people and asked WHY, they would not answer because the answers would show how nasty and evil they are.

When President Obama chose a woman to be a federal judge, some people brought race into it. There is no problem with having white male judges who are racist but oh no, can't have prejudice judges of color. The purpose of having Rules of Law is that everyone is suppose to go by the rules and put aside their prejudices. Unfortunately, in the south, many officials are racist and use their positions to violate the rights of citizens of color. This is about a man's life. This is not a game where the referee turns his head and pretends not to see a purposeful foul or a punch below the belt. The defendant has already had years of his life taken from him, have been separated from his family including his children, but what about when he gets out? Forever he will be labelled a sex offender because some white men are racist and are positions to do what they want to his life. And ex-prisoners can't VOTE.

On Thursday, it will be three weeks since I sent an e-mail to Mr Eric Holder, the United States Attorney General. I know that anything concerning the federal government takes time but it would have showed that Mr Holder and the United States Department of Justice - the Criminal Department or the Civil Rights Department - cared just by replying to say there will be an investigation and a fair trial for the defendant and I would be contacted later. Why is everything a stall and a wait?

Elected officials know how to reach us when they want our vote but then act like we are not important enough for them to respond to our complaints. I voted for Barack Obama to be President of the United States. He picked Mr Holder to be Attorney for the United States. I am an American citizen and I have reported a crime. Not one official contacted at the state and federal level have investigated this case or showed concern for the safety of my family.

A few months ago, I received a call from a woman who was working the phones for someone running for a political office. She said this person was endorsed by Barack Obama. I told her that I had not decided if I was going to even vote. She said "Oh God or oh Lord". God has nothing to do with it. Why should I vote for another politician who knows my name when they want my vote but ignores me when I simply ask for them to do what they should do - uphold the laws of the United States Constitution?

The names of the officials in Danville who have broken the law by violating the Constitutional Rights of the defendant need to go to prison. I want to see them with handcuffs on. I want justice. The names of Virginia officials who did nothing about this case also need to be known in case they want to hold higher offices. If they don't respect the law then they should not be officials at any level. They need to be fired.

If I do not receive an e-mail from Mr Holder, the United States Department of Justice by Thursday, or Friday, I will start posting the letters from officials. I also want to post the testimony from the preliminary hearing and the trial. I have not up till now because I don't want to be accused of trying to tell defense witnesses what to say. But it is already public record which anyone can buy if they have the money. But I'm going to make it public right here on this blog for anyone who wants to read it for themselves - FREE. It's time for the public to know what the corrupt officials don't want revealed in a real trial.

I'm tired. I'm tired of the injustice. I'm mentally weary after seven years of this being constantly on my mind. I'm tired of being disappointed because officials will not do the right thing. I am only asking for what the defendant is entitled to - a fair trial. I continue to seek justice to honor those who came before, those who were enslaved but endured, those who were abused and killed just to have equal rights ..... the right to live free.

Order For Discovery ...

(Page 35) ORDER FOR DISCOVERY AND INSPECTION AND FOR EXCULPATORY EVIDENCE

Came this day the defendant for his Motion for Discovery and Inspection and the Exculpatory Evidence and was argued by counsel.

It is ORDERED, ADJUDGED and DECREED that:

The Commonwealth produce and make available for the defendant's trial or trials any and all evidence, materials and/or information of whatever form, source or nature, whether written, recorded or otherwise, that is within the possession, custody or control of the Commonwealth or its agents, as well as any materials of like nature which, by the exercise of reasonalbe diligence should be known by the Commonwealth and which concern any of the charges pending against the defendant in this Court including the following:

1. Any written or recorded statements and confessions or copies thereof, as well as the substance of any oral statements or confessions made by the accused to any law enforcement officer.

2. Any criminal record of the accused.

3. Any and all evidence, material, or information which tends to exculpate the defendant, or which tends to establish a defense in whole or in part to the charges against the defendant, or which may tend to reduce the penalty which the defendant may suffer if convicted of any of these crimes through an indication (page 36) of innocence or through the potential impeachment of any prosecution witness, be it by inconsistent statements or otherwise. This includes, but is not limited to, the following:

a. A copy of or notice of any criminal convictions that may be used to impeach the Commonwealth's witnesses as to all charges against the defendant.

b. All evidence and information affecting or potentially affecting the credibility of any witness for the Commonwealth on any of these charges, including but not limited to:

i. and evidence or information of bad reputation in the community for truthfulness of any witness for the Commonwealth which may be used as a basis for impeachment by the defendant;

ii. any evidence or information of prior inconsistent statements made by any witness for the Commonwealth which may be used as a basis for impeachment by the defendant;

iii. any evidence or information showing bias or prejudice against the defendant on the part of any witness for the Commonwealth which may be used for impeachment by the defendant including any evidence of promises or inducements offered witnesses in exchange for testimony;

iv. any evidence of any mental or physical impairment of any witness for the Commonwealth which would affect their ability to observe, recall or relate facts in this matter such as alcoholism, drug abuse or addiction, mental health treatment, etc., whcih may be used for impeachment by the defendant;

v. any evidence of complicity of any witness for the (page 37) Commonwealth in the acts for which the defendant stands accused which may be used for impeachment by the defendant;

c. Any and all statements by witnesses or others which may tend to exculpate the defendant.

It is finally ADJUDGED, ORDERED and DECREED that the Commonwealth's Attorney provide the foregoing information and responses to the defendant at the Office of the Public Defender for the City of Danville, in writing, within ten days of entry of this order.

The above is from the defendant's case file that I received from the public defender with the permission of the defendant. It was signed by the public defender but the section for DATE and ENTER (Judge) is blank. There are several papers like this in the defendant's file.

I don't like using the words "public defender" because the person this title refers to was clearly not working in the best interest of the public or the best interest of the defendant. I don't know if it is true or not but I have heard that the public defender of this case is now a prosecutor out in the county. If that is true, I guess he showed that he was a good ole boy and officially got to join their team. If that is true, one can only wonder how many he has prosecuted and sent to prison.

There was no medical records presented in court. The public defender told me he wasn't allowed to see the medical records, yet, he wrote in the defendant's file:

no vaginal tears - no vaginal or pelvic bruising - no cuts - no pictures - no PERK evidence.

In his notes he also wrote, before the trial (page 89): her credibility - inconsistencies denials impeached by others.

According to the ORDER FOR DISCOVERY AND INSPECTION AND FOR EXCULPATORY EVIDENCE the defense was entitled to many things that were never officially turned over to the defense because it is not in the defendant's file. Where are the statements from accuser where she made inconsistent statements before the trial? Where are the statements from the people the accuser claimed she told about the alleged rape. Where is the towel? Where are the medical records?

In the file I received there is no COMPLAINT sheet from the accuser concerning the defendant but there is a COMPLAINT sheet (page 137) where the accuser filed a complaint against someone else who she claimed entered her bedroom while she was sleeping. The accuser wrote it out and signed it, but there is no such sheet concerning this case.

The detective and the patrol officer testified that notes were taken when they spoke to the accuser on February 17, 2003, but neither had any notes with them when they testified. There are no police interview notes in the defendant's file that I received.

The police and prosecution have access to evidence and get to question witnesses. But don't turn over evidence and statements to the defense that could help the defendant. So all the prosecution has to do is not turn over statements and medical records to the defense even though legally they are suppose to. And court officials just have to ignore the inconsistant testimony of the accuser and not accept the testimony of defense witnesses that impeach her. And how do they get away with doing this, well, in this case, no jury trial, no press, no public notice. So basically, this fake case was done behind closed doors.

Since I've been reading about the difficulty that defense lawyers are having getting a fair trial for their clients, it is disheartening to know just how nasty officials can be and that the oath they took does not mean anything to them.

When I first tried to get a lawyer back in 2003, he told me he had to fight for a fair trial. Fight for a fair trial? In America, the U.S. Constitution states that the accused has a right to a fair trial, legal representation and a fair appeal.

Is America ran by real American's anymore? It seems like foreigners have taken over America's legal system and is trying to lock up as many American citizens as possible. I know that there has always been racists holding positions at the city, state and federal level. And I know that greed plays a big part in putting people in prison. But I don't understand how this is allowed to continue. Where are all the American officials who are not racist and greedy and that do believe in the United States Constititution? Where are you?

America goes to other countries, give money and soldiers but in the United States America citizens get no protection from corrupt officials and no fairness in court. This is all like something in a movie. This is like something that happened back in the 1900's. This is more weird and scarier than any horror movie because this is actually happening. TODAY!

I stood in my hall window one day and watched the grey helicopters that had left the airport and was heading to I suppose a military base. I cried. My tears flowed because some young people were leaving and might not return home alive. I cried because some of them was going off to put their lives on the line to protect their country and if they made it back home alive, representatives of the law would not give them a fair trial if they were accused of anything illegal. I weeped because officials in my town my state didn't care about my life or the life of anyone on those helicopters.

I asked for protection and was ignored. The defendant did not receive a fair trial but officials in Virginia do not care.

On February 10, 2003, the accuser told her cousin to bring the defendant to her house. All three used drugs together. When the cousin and defendant were leaving, the accuser wanted the defendant to stay.

On February 13, 2003, the accuser was riding and calling around looking for the defendant. She told a defense witness that if she didn't find the defendant that she would have storage for his ass.

On February 14, 2003, (Valentine's Day - 4 days after the alleged rape), the accuser again wanted her cousin to bring the defendant to her house. The defendant had another girlfriend.

On February 17, 2003 (a week after the alleged rape), the accuser went to the police station. She spoke to the tampering detective.

Tuesday. The detective went to the defendant's house. The accuser testified that's when she gave him a towel that she had thrown in the trash, but no towel was presented in court. The detective said nothing about a towel when he testified.

Tuesday. The defendant went to the police station when he heard the police wanted to talk to him. He had to wait. When someone finally talked to him, he was answering questions while they swabbed his mouth. Two or more detectives were present but no one signed the defendant's statement. The defendant left the police station. A few weeks later the accuser signed the complaint. The defendant was arrested. His bail was $1,000.

At the preliminary hearing the accused testified that her cousin was there on the 10th, but at the trial she said he wasn't there. She denied sending him for the defendant. When she slipped and said "when P left" the public defender cut her off. P is her cousin.

At the preliminary hearing the accuser said she was in shock and didn't know how she got to work during that week. She wasn't in shock when she was calling and riding around looking for the defendant. She said she went a whole week before telling someone she had been raped. When the preliminary hearing judge asked her who was the first person she told, she named a co-worker and gave details. But at the trial, she omitted the co-worker and said she told several people before going to the police. Not one of the people she claimed she told came to court to testify for her. Not one of her family members or friends came to court to testify for her or give support. Her cousin testified for the defendant. The statement from the co-worker did not back up what the accuser claimed so she was not called as a prosecution witness. Why did the public defender not summon her as a witness? Why did the public defender not play the audio tape from the preliminary hearing?

The accuser said her cousin knew about it because she used his cell-phone to call her mother. That also doesn't match what she said at the preliminary hearing about waiting a whole week before telling someone. Her cousin said he didn't find out about her claim until after the defendant had been to the police station. That was a week after the alleged incident. He testified that he found out about what she claimed not from the accuser as she claimed but from the defendant's mother after the police was looking for the defendant. The cousin testified that is when he went to see the accuser. Because the cousin impeached the accuser, the prosecutor spoke to the cousin as though it was a crime to testify to what he knew.

The cousin had been staying off and on with the accuser during that time because his lights had been turned off. That set the month. Because the accuser testified that before the 10th she had not seen the defendant since the end of January. He said he saw no change in the accuser's appearance or personality. He sometimes picked the accuser up from work. In his interview with the public defender, he said he thought the accuser would lie in a minute. She wanted him to bring the defendant to her house on February 14, 2003. He stated that he had been giving her some money for letting him stay there and he would buy food. She wanted more money for drugs.

The accuser said herself that she couldn't get the defendant to talk to her unless she gave him drugs. That's why she told her cousin to get drugs and bring the defendant to her house. The judge said the cousin was a drug user. He disregarded the cousin's testimony because it impeached the accuser. He accepted the perjured testimony of the accuser who admitted to using drugs that night. She couldn't remember if she performed oral sex on the defendant that night.

In the interview with the public defender, the co-worker did not back up what the accuser claimed at the preliminary hearing. The public defender didn't even summon the co-worker to further impeach the accuser. But the prosecution put on a patrol officer who had nothing to contribute, who couldn't even remember the name of the person she claimed the accuser gave her. The patrol officer claimed she took a report but she didn't have it with her in the court room.

As you read testimony from the preliminary hearing and trial, you will see that the defendant was going to be found guilty before the court room lights clicked on. It came down to the word of the accuser and the defendant. The defendant had witnesses that impeached the accuser. The accuser impeached herself by making up stories and changing them as she went along. Even before the trial the public defender wrote in his notes that the accuser had been impeached by others and had inconsistences.

The accuser also claimed she was beaten, but had no physical proof of it. She said he ejacualated inside her and she had proof on a towel. But at the trial, she said she couldn't remember if he did. She claimed she was on medication but had no proof of it. She said she was raped but had no proof of it.

In a court of law, more is needed than the accuser saying someone did something illegal to her and then she keeps changing her testimony. And have nothing to back up what she claims.

In Danville, an accuser can claim whatever and don't need to prove her it. No she is not white. But the defendant is a black man. Ever wonder why there are more black people incarcerated than anyone other group. One way or another,

Neither the detective nor the police officer added anything relevant to the state's case. Notice as you read that the accuser said nothing about giving a statement to a patrol officer. She said she left the magistrate and spoke to the detective. So what was the point of having the patrol officer testify unless they just wanted there to be more state witnesses than defense witnesses? I have another theory about that - which will come out if there is a real trial. If the public defender had put on all the witness in the waiting room, there would have been more defense witnesses. The public defender didn't even summon other people who could have been defense witnesses. This shows even more that the public defender was not working in the best interest of his client. The public defender is paid by the state. Perfect setup.

-----The Public Defender
The public defender did not play the preliminary hearing audio tape at the trial. He did not mention the tape in the appeal petition. He also did not include in the petition (among other things):

> witness tampering

> testimony of the accuser impeaching herself. (He wrote in his notes before the trial that the accuser was inconsistant and had been impeached by others but he didn't point any of that out in the petition.)

> testimony of defense witnesses who impeached the accuser. (Anyone reading the petition would think the defendant had no witnesses.

> medical records. No medical records were presented in court. The public defender told me he wasn't allowed to see medical records, yet, he wrote in the defendant's file:

no vaginal tears - no vaginal or pelvic bruising - no cuts - no pictures - no PERK evidence

The dishonorable judge told a reporter after the sentencing that he looked at medical records behind closed doors.

The head public defender resigned. The public defender on this case resigned. The new head public defender also would do nothing.

They are public defenders of what - the old south?

----------The Media
Danville's one and only newspaper was not at the trial. No coverage was given on this case until we contacted the paper. The paper would not print letters to the editor about this case. When I asked the editor why this case was not covered, he said he didn't make assignments or something. The paper interviewed court officials after the sentencing but would not talk to us. The paper also would not print or investigate anything about the tampering detective. The editor asked me why the detective would do that. He's a newspaper man in Danville and he ask why a police officer would tamper with a witness. He also said he read the defendant's statement and he was guilty. You see, that is how things are done here in Danville, behind closed doors and defendants are guilty no matter what is presented in their favor.

A local call-in news show cut me off twice when I tried to talk about the tampering detective. Officials are not allowed to be talked about in the media but anyone else accused of something has their name address and picture used by the media.

The tv talk show hostess is black. The second time I called, I was cut off the air again but she stayed on the line and told me to tell her what was going on. I did, so she gave me the phone number of the stations head office. When I finally reached someone, the guy said something was wrong with the mobile unit. Funny, that's what the other news station said. Now the mobile unit works fine to cover a story about a chicken but not so for a case involving a police detective that tampered with a defense witness. Ever wonder why the police is on the side of the prosecution? And why the media is on the side of the officials? It works that way here.

The black hostess announced on air for me to call her because she didn't have my phone number. I received two calls from friends who heard the announcement. I called the station and left my personal information. A short time later, the hostess had left the show. The guy covering her spot said she left complaining about corruption. I'm thinking she wanted to do a story on what I told her and wasn't allowed to. She probably wasn't even given my personal info.

The media covers stories of corruption and scandal when it involves politicians and celebrities. The stories of ordinary citizens get little to no coverage. Corruption and scandal by Virginia officials isn't a big enough story or the media is still prejudice. Either way, no story is released. The truth must not be told.

This case will demonstrate that the tampering detective is not the only official who intentionally broke the law. This injustice was no mistake. It was planned. You know, how Hitler planned his massive crime of extermination and how the U.S. planned the massive crime of slavery, and Japanese American camps, and the abuse of Original Americans. These horrific events don't just happen by chance, they are planned. The new massive crime is to imprison Americans for profit.

Wake up America. It's past time for the slogans of the United States of America to mean something. If we are FREE & BRAVE & FAIR & EQUAL then we must be FREE & BRAVE & FAIR & EQUAL and do something. If we continue to just turn our heads not wanting to believe that these nasty things still happen and is happening here in America, it will only get worse.

Black people in America are 12% of the population but has the majority in being locked up. Most slaves in America were also black. Coincidence? I don't think so.

Will you or someone you love or know be the next to face corrupt officials. Don't think it can't happen to you. And don't think it just happens to people of color because it is not only racism that fuels the ship of injustice but greed. Prisons have to be filled to make money. Will you be the next one denied your legal rights and sent to prison without a fair trial?

Tampering - Intimidation - CoverUp

-----WITNESS TAMPERING
In 2003, a Danville police detective tampered with a defense witness during a rape trial. The public defender did nothing about it. The public defender, the head public defender, and the assistant D.A. resigned soon after I began contacting state officials. The new head public defender also would not do anything about the witness tampering. In 2008, the head district attorney resigned when the USA got a new President which means a new head U.S. Attorney.

The defense witness tampered with saw the accuser at a convenience store. The accuser said the defendant did not rape her but he'd wish he did. This witness had drug indictments against him. After this witness was removed from the witness room by the detective he suddenly didn't know why he was in court.

-----POLICE INTIMIDATION
The police have been to my home, watched and spotlighted my home. My mail was tampered with and some is missing, including letters sent to Black-owned newspapers and to an out-of-town lawyer. I had to put extra locks on my doors and contemplated getting a weapon to protect us from the police. My mother is in her seventies and in ill health. This has been a stressful time for her.

In 2004, I was close to a nervous breakdown due to what the police was doing to us. It was hard leaving my mother alone when I went to work with the police sitting outside our home. Just in case the police came to the door while I was gone, I put phone numbers on the wall so my mother could call me, neighbors and relatives. I would be at work and just start crying. Imagine the feeling of driving home at night down a road and suddenly headlights hit the back window. That is an eerie feeling. At night moving from window to window checking to see if the police are outside. Taking my dog outside at night with the backyard being close to the street. The police coming to the door on some phony reason. How many people are suppose to live at my home. Try being pulled over by the police claiming a redlight was ran but no ticket was given. Nobody should have to live like that in America. America, where police kill unarmed Black people.

-----COVER-UP
From 2003 through 2007, I contacted Virginia officials who either didn't reply or claimed they could do nothing about witness tampering and police intimidation. The following are their replies:
> Virginia State Bar replied that it's authority is limited. They did nothing about the public defender or the witness tampering.

> State Attorney's office replied that they represent the State. They represent corruption?

> Virginia Court of Appeals were sent a fair trial petition which contained signatures of Danville citizens and each judge was sent information about this case. Not one judge inquired what was going on. The defendant has not been given an appeal attorney. Now if my mail got through, each had enough information to see that the defendant did not receive a fair trial, but not one of them cared enough about the law or the defendant to find out what was going on. If they did not get my mail, then where is all that mail. Either way, it says volumes about justice in Virginia. There is no justice here.

> The U.S. Attorney in Richmond, VA (DOJ) did not reply to my letter requesting an investigation and protection for me and my family.

> The U.S. Attorney in Alexandria, VA (the Eastern District), replied that my letter was forwarded to the Western District U.S. Attorney in Roanoke, VA. It is now 2010 and the Roanoke office still has not replied.

> I called the U.S. Attorney in Richmond and left a voice-mail. When Mr J returned my call, I told him about the detective. I told him about the police coming to my home, watching my home, etc. I asked for an investigation and protection. He said this was a State matter, to contact the State Attorney. When I told him I already had he said to call the police. Yeah, right, the police will investigate themselves. The United States Dept of Justice in Virginia just ignored the complaint so there is no justice in Virginia.

> The governor's office replied to my fax that the governmor does not have the authority to intervene in legal matters. No investigation and no protection.

> In 2005, I called C-SPAN and spoke to a Senator. He told me to contact the State Bar and congressman.

> In 2007, the new state attorney and new governor also claimed to not have the authority to do anything.

I contacted Lawyer Referral wanting to get an appeal attorney and a civil rights lawyer. The reply was that there was no Virginia lawyers listed who handle cases for prisoners. I'm not a prisoner. Lawyer Referral is part of the Virginia Bar. Get it? To get one lawyers name just for a 30 minute consultation at the time cost $35. I wasn't about to waste money getting names of attorneys referred by Virginia State Bar.

Well-well-well. No officials in Virginia has the authority to do anything about witness tampering and police intimidation and don't care that the defendant was denied his rights - not even the Governor or the Department of Justice. State and federal officials just ignore the complaints and allow this atrocious and illegal behavior to continue.

Constitutional rights, rules of law, obstruction of justice, witness tampering, police intimidation means nothing in Virginia.

With this type of behavior from officials no wonder so many people of color are incarcerated.

In America, no one is suppose to be above the law, but officials are because they protect each other. Black Danville citizens have no protection from corrupt/racist officials.

Call up a defense lawyer in your town and see if you can get an office appointment when you say witness tampering by a police detective. I couldn't.

An out of town lawyer I contacted on my own wanted $5,000 just to read the trial transcript. Rich people don't get off because they are rich but because they can afford to hire lawyers to protect their legal rights and present their case and report misconduct by other officers of the court.

I'm not asking the readers of this blog to determine the defendant's innocence or guilt based on what you read here. He has been denied these rights. Would you want to be accused of any crime, and have to go before a judge, prosecutor and public defender (all white) and have a fake trial. A trial behind closed doors with no jury, no press, and no public notice. Would you want a trial where a witness was tampered with, witness testimony disregarded even though they impeached the accuser, not have all your witness testify or even summoned? Behind closed doors. What does that sound like to you?

Introduction

I am publishing this blog hoping that it will give some protection to me and my family. What you are about to read will make it clear how corrupt some court officials and the police are in Danville, Virginia. As you read this blog, you will probably think it is about a case from the 1900's, but it is happening now, in this new millenium. I am not asking readers to decide innocence or guilt of the defendant in the case you are to read about, but if you really believe in American Law then you believe that every defendant is entitled to a fair trial, legal assistance and a fair appeal. The defendant in the following case has been denied his Constitutional Rights .

This case includes witness tampering by a police detective, police intimidation, cover-up by Virginia state officials and more. Because this case involves corrupt/racist Danville officials from a judge on down, Virginia state officials have shut this case down without an investigation. The defendant has been in prison for seven years and has not been given an appeal attorney. IT'S A COVER-UP!

Right after I get part of this blog up, I will send an e-mail to U.S. Attorney General Mr Eric Holder. In the e-mail I will request an open investigation and a new trial, a fair one, for the defendant in this case. Since Virginia officials I contacted, claim to not have the authority to do anything I am contacting the United States Department of Justice in Washington, D.C. because there is no justice in Virginia for Black citizens.

To keep this blog from being taken down, I will not post the names of people but titles. (You can use Wikipedia to look up some of the names of state officials who were in office from 2003 to 2007. 2007 is the last year that I contacted state officials. The information I have sent to Mr Holder will have the names of everyone that I know the names of. The defendant was given a quick unfair trial behind closed doors so let's see how long it will take before the Department of Justice in Washington, D.C. will reply to this request and give the defendant a REAL fair trial. I will post the response from the USDOJ when I receive it.

I reside in Danville, Virginia, the last capital of the confederacy. Some Danville officials behave no better today than they did in the 1900's. In 1963, Black protesters were beaten by Danville officials for simply wanting to be treated like American citizens. When the Reverend Martin Luther King, Jr came to Danville, he said:

"We have certainly been with you in spirit and we have agonized with you as you have faced the brutality and ruthlessness of a vicious police force. I've seen some of the brutal things on the part of policemen all across the South in our struggle. But very seldom, if ever, have I heard of a police force being as brutal and vicious as the police force here in Danville, Virginia. And you have stood up amidst this with great courage and you have done it with great discipline and great dignity." --Reverend Martin Luther King, Jr.

Danville's Black and White citizens are trying to get along better, that's why there was no public notice and jury trial. Getting an all-white racist jury is no longer a guarantee. Criminal trials should not be done behind closed doors with southern white men deciding the fate of a black man. As you read, you will see why the court did not want this case public.

In 2007, The Virginia General Assembly voted to apologize for slavery and for turning their heads to the abuses against Black citizens in the past. As usual, words don't mean anything to officials who toss them out like peas to feed people but then they step on them, crushing the peas and any hands that dare to reach for them.

It's now 2010, a new millennium, yet, corrupt/racist Danville officials still deny black citizens our Constitutional Rights and state officials cover-up for them.. The following case will demonstrate the truth of that statement.

And is the local white media in Danville any different than they were before or during the Civil Rights Movement? NO! We are still denied access to the white media.

I thank the publisher of the Piedmont Area Journal, a black-owned newspaper in Virginia. I truly believe that the police intimidation didn't become worse with us because the PAJ printed my letters to the editor about this case. It took some doing to get it to him because the first one was never delivered by the U.S. post office. And that is not the only mail of mine that is missing.

The letter I sent to the United States Department of Justice in Washington, D.C. several years ago was returned to me. How can the U.S. Post Office not know where the USDOJ in Washington, DC is? What if I had sent information about something concerning national security? Where is my mail?

In elementary school, I pledged my allegiance to my country. Not all wars are fought on foreign soil with bullets and tanks. I'm fighting American terrorists here, who wear badges and black robes. I fight with words and my belief that there are officials who will honor the oath they took to defend and protect the U.S. Constitution, which will only have value when it is used to protect and grant to ALL citizens the same equal rights. By the laws of the United States Constitution, black citizens also have a right to a fair trial, legal representation and a fair appeal.

Because I am an American.

America is my country. It is where I was born and raised. It is where my ancestors were slaves. Danville is where my mother's door was broken down by the police before I was born. It is where the police threatened to break down her door in 2004. It is where her son has been put in prison without a fair trial, therefore enslaved. It is where the police can come to her door or sit outside her house at any time of the day or night. It is where a police car can shine headlights on her bedroom window at 3:30am until day break. Danville is were the police can tamper with a witness and Virginia is where nothing is done about it.
